[Users] wms getlegend mine type trouble in TreePanel

Hi all,
I am using geoext 1.0  with MapServer 6.01 on my Ubuntu server.
 
Despite I have set the mapfile output to
 
IMAGETYPE AGG_Q
 
  OUTPUTFORMAT
    NAME 'AGG_Q'
    DRIVER AGG/PNG
    IMAGEMODE RGB
    FORMATOPTION "QUANTIZE_FORCE=ON"
    FORMATOPTION "QUANTIZE_DITHER=OFF"
    FORMATOPTION "QUANTIZE_COLORS=256"
    MIMETYPE "image/png; mode=8bit"
   EXTENSION "png"
  END 
I am getting a request of my legend images im my ext tree
(Ext.tree.TreePanel with legend images, "gx_overlaylayercontainer",) to be
default to gif - which results in blurry output images.
 
manually I can get what I need :

(in MapBender this render ok with the same MapServer settings - that's why I
think this should be a geoext related issue)
How can this be fixed ?
